The First Civil Chamber of the Ticino Court of Appeal dealt with an appeal in an interdiction proceeding brought by the tutelary delegation against a decision of the supervisory authority. During the appeal, the person concerned died. The court held that the proceeding had thereby lost its object and ordered the case struck from the roll. In view of the special circumstances, it waived court fees and costs and also refused any party compensation, especially because the appeal had not been served on the respondent.
When the person concerned dies during pending interdiction proceedings, the procedure loses its subject matter and becomes moot; the appeal is therefore to be struck from the roll. In such circumstances, and particularly where the appeal has not yet been notified to the opposing party, the court may waive the collection of court fees and costs and deny party compensation (consid. 1-2).

ritenuto che la particolarità della fattispecie giustifica di soprassedere al prelievo di tasse e spese;
osservato che non si giustifica di assegnare ripetibili alla controparte, cui l'appello non è nemmeno stato intimato;
decreta: 1. L'appello è dichiarato privo d'oggetto e la causa è stralciata dai ruoli.
