premesso che con decreto del 31 ottobre 2002 il Pretore del Distretto di Lugano, sezione 6, ha stralciato la causa dai ruoli per intervenuto decesso di __________ __________ il __________ __________ 2002, negando a __________ __________ il beneficio dell'assistenza giudiziaria;

accertato che contro il giudizio appena citato __________ __________ ha introdotto un ap­pello il

25 novembre 2002 per ottenere il beneficio rifiutatole dal Pretore;

ricordato che con ordinanza del 29 novembre 2002 la presidente di questa Camera ha accertato la sospensione della procedura a norma dell'art. 104 CPC;

preso atto che il 5 febbraio 2003 l'appellante ha comunicato di ritirare l'appello;

stabilito che nelle circostanze descritte rimane da statuire sugli oneri processuali e le ripetibili di secondo grado;

rammentato che, di regola, il ritiro dell'appello equivale a desistenza, sicché il recesso da una lite comporta l'obbligo di sopportare le tasse e le spese cagionate (Rep. 1990 pag. 284, 1978 pag. 375 seg.);

ritenuto nondimeno che le particolarità della fattispecie giustificano di soprassedere a ogni prelievo, né è il caso di assegnare ripetibili alla controparte, cui l'appello non è nemmeno stato intimato;

richiamato l'art. 352 cpv. 1 e 2 CPC,

decreta: 1. Si prende atto del ritiro dell'appello. La causa è stralciata dai ruoli per desistenza.
