The Second Civil Chamber of the Ticino Court of Appeal dealt with an appeal against a Lugano pretorial decision. Before the court decided the merits, the appellants’ lawyer filed a statement withdrawing the appeal. The court held that the proceedings had therefore become moot and removed the appeal from the docket. The appellants were ordered to bear the CHF 100 court fee and to pay CHF 100 in party compensation to the respondent.
Art. 351 CPC; withdrawal of appeal and mootness of appellate proceedings. Where the appellant withdraws the appeal by filing a written statement, the appellate court shall strike the proceedings from the roll as the case has become devoid of object. The withdrawal does not prevent the court from allocating costs to the withdrawing appellants and ordering them to pay party compensation to the respondent, in accordance with the applicable procedural and fee rules (consid. 1-2).
