The Second Civil Chamber of the Ticino Court of Appeal dealt with an appeal against a Lugano district court decision. After the appellant’s counsel filed a written notice withdrawing the appeal, the court held that the appeal proceedings had become moot and ordered the appeal stricken from the docket. It also decided that no fees or costs would be collected.

When the appellant expressly withdraws the appeal, the appellate proceedings lose their object and the court strikes the case from the roll without examining the merits.
