The appellant challenged the 23 January 1997 decision of the Pretura of Locarno-Città. After the president of the Second Civil Chamber ordered an advance on costs of CHF 600 and warned that nonpayment would result in dismissal under Art. 312 CPC, the deadline expired without payment. The court therefore struck the appeal from the docket and charged the appellant CHF 80 in costs.
Art. 312 CPC; nonpayment of the ordered advance on costs within the fixed time limit entails that the appeal is removed from the docket as deserto. Where the president has validly warned of this consequence and the deadline expires unused, the appellate court need not examine the merits; the appellant bears the costs of the proceedings (consid. implicit).

Richiamata la diffida 17 febbraio 1997 del presidente di questa Camera mediante la quale al ricorrente veniva assegnato un termine scadente il 7 marzo 1997 per effettuare sul c.c.p. 69-10370-9 del Tribunale d’appello -introiti AGITI- un deposito di
fr. 600.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;
preso atto come il termine in questione sia infruttuosamente trascorso;
decreta 1. L'appello 12 febbraio 1997 di __________ , avverso la decisione 23 gennaio 1997 del Pretore di Locarno-città, di cui sopra, è stralciato dai ruoli per mancato versamento dell'anticipo.
Le spese del presente giudizio con tassa di giustizia per complessivi fr. 80.-- sono poste a carico dell'appellante.
