The Second Civil Chamber of the Ticino Court of Appeal dealt with an appeal against a 4 February 1999 decision of the Bellinzona Pretura. After ordering the appellant to pay an advance of CHF 500 by 15 March 1999 and warning that non-payment would cause the appeal to be declared deserted under Art. 312 CPC, the court noted that no payment had been made. It therefore struck the appeal from the docket and ordered the appellant to pay CHF 80 in costs.
Art. 312 CPC; failure to pay the ordered advance on costs within the fixed time limit results in the appeal being treated as deserted and struck from the roll. Where the warning expressly provides for that consequence, the appellate court may remove the matter ex officio once expiry of the deadline is established. The defaulting appellant bears the procedural costs of the aborted appeal proceedings (consid. 1-2).

Richiamata la diffida 23 febbraio 1999 del presidente di questa Camera mediante la quale alla ricorrente veniva assegnato un termine scadente il 15 marzo 1999 per effettuare sul c.c.p. 69-10370-9 del Tribunale d’appello -introiti AGITI- un deposito di
fr. 500.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;
preso atto come il termine in questione sia infruttuosamente trascorso;
decreta 1. L'appello 17 febbraio 1999 della spett. __________ , avverso la decisione 4 febbraio 1999 del Segretario assessore della Pretura di Bellinzona, è stralciato dai ruoli per mancato versamento dell'anticipo.
Le spese del presente giudizio con tassa di giustizia per complessivi fr. 80.-- sono poste a carico dell'appellante.
