After the first-instance court revoked suspensive effect, the appellate court did not examine the merits of the appeal. It returned the file to the Pretura for attachment to the record and stated that, if the appeal was maintained, it would be handled only together with any later appeal concerning suspensive effect. Visto l'appello 28 marzo 2000 presentato dall'attrice avverso il decreto 7/8 marzo 2000

dal Pretore del Distretto di Lugano, sezione 3, con il quale è stata respinta l'istanza di

restituzione in intero 16/17 novembre 1999 presentata dalla qui appellante, ed al quale

il Pretore aveva concesso l'effetto sospensivo.

Richiamata l'odierna decisione pretorile con la quale viene revocata la concessione dell'

effetto sospensivo e considerando che in tale circostanza l'esame dell'appello viene dif-

ferito con la trattazione di una eventuale successiva appellazione sospensiva,

decreta:

  1. L'appello 28 marzo 2000 della __________

avverso il decreto 7/8 marzo 2000 del Pretore del Distretto di Lugano, sezione 3, è retrocesso alla stessa Autorità di prima istanza che lo allegherà all'incarto e -se mantenuto- verrà evaso in occasione di una eventuale appellazione sospensiva.

-La presente procedura viene stralciata dai ruoli.
