che il Pretore ha accolto, con decreto 17 dicembre 2001, ordinando lo sfratto immediato dei convenuti dall’appartamento al primo piano sito nello stabile __________ in via __________ a __________, di proprietà degli istanti;

ed ora sul reclamo (recte: appello) 30 dicembre 2001 del convenuto __________;

Considerato

in fatto ed in diritto

che con decreto 17 dicembre 2001 il Pretore, preso atto che il contratto di locazione tra le parti era stato validamente disdetto in base all’art. 257d CO (mora del conduttore) per il 30 novembre 2001, ha accolto l’istanza 4 dicembre 2001 degli istanti, formanti la comunione ereditaria fu __________, ed ha ordinato lo sfratto dei convenuti coniugi __________ dall’ente locato;

che con scritto 30 dicembre 2001 il convenuto __________ ha inoltrato reclamo (recte: appello) contro la decisone pretorile, da un lato rievocando le circostanze che a suo tempo gli avevano impedito di pagare le pigioni e dall'altro auspicando il differimento dello sfratto fino al 1° febbraio 2002, data per la quale verosimilmente avrebbe trovato una nuova sistemazione;

che l'appello in questione, a prescindere dalla sua manifesta irricevibilità in ordine siccome fondato su circostanze fattuali esposte per la prima volta in questa sede (art. 321 cpv. 1 litt. b CPC), non poteva in ogni caso essere accolto nemmeno nel merito;

che in effetti l'appellante non ha assolutamente spiegato per quale motivo il giudizio con cui il Pretore aveva decretato lo sfratto sarebbe errato, avendo egli anzi confermato di essersi trovato in mora nel pagamento delle pigioni, mentre il differimento dell'esecuzione dello sfratto, da lui concretamente postulato, non è previsto dalla nostra legislazione (Cocchi/ Trezzini, CPC-TI, Lugano 2000, m. 9 ad art. 508);

che lo scritto in questione può così essere evaso già all’esame preliminare dell’art. 313bis CPC senza necessità, per economia di giudizio, di intimarlo alla controparte per le osservazioni;

che, stante la particolarità del caso, non si prelevano né tasse di giustizia né spese;

Per i quali motivi

Visti gli art. 506 e segg. e 313bis CPC

pronuncia

  1. Il reclamo (recte: appello) 30 dicembre 2001 di __________ è respinto.

  2. Non si prelevano né tasse né spese.
