In an appeal against an interim measure ordering a land-registry annotation of a restriction on the power of disposition over two parcels, the appellant withdrew the appeal with the respondent's consent. The Second Civil Chamber of the Ticino Court of Appeal consequently struck the appeal proceedings from the roll. It ordered judicial fees and costs of CHF 50, already advanced by the appellant, to remain at her expense and compensated party costs.
Art. 352 CPC; withdrawal of appeal and discontinuance of appellate proceedings; costs on withdrawal. Where the appellant withdraws the appeal, with the consent of the opposing party, the appellate court strikes the proceedings from the roll. In such a case, the court may allocate judicial costs to the withdrawing appellant and order compensation of party costs pursuant to the applicable cost rules (consid. 1-2).

Atteso che, con scritto 31 luglio 2003, il patrocinatore della parte convenuta ha comunicato, con il consenso della controparte, di voler stralciare la procedura d'appello con le spese a carico di chi le ha anticipate e compensate le ripetibili.
Visti l'art. 352 CPC e, per le spese, gli art. 147 e seg. CPC e la vigente TG
pronuncia
La procedura d'appello inc. no. 12.2003.90 di questa Camera è stralciata dai ruoli.
La tassa di giustizia e le spese in complessivi Fr. 50.-, già anticipate dall'appellante, rimangono a suo carico, compensate le ripetibili.
