The Ticino Court of Appeal’s Execution and Bankruptcy Chamber struck an appeal from the docket because the appellant paid the ordered advance on costs only after the peremptory deadline had expired. The court relied on the warning that failure to pay within the set time would lead to the appeal being treated as deserted under Art. 312 CPC. It also ordered the appellant to bear the proceedings costs, set at CHF 50.
Art. 312 CPC; late payment of a court-ordered advance on costs: where the appellate court fixes a peremptory time limit for payment of the advance on costs and expressly warns of the consequence of non-payment, payment made after expiry of the deadline is untimely and justifies striking the appeal from the docket. The peremptory nature of the deadline precludes taking account of a subsequent payment (consid. implicit). Procedural costs may be charged to the appellant as the unsuccessful party.

richiamata la diffida 4 novembre 1999 del Presidente di questa Camera mediante la quale al ricorrente veniva assegnato un termine scadente il 22 novembre 1999 per effettuare sul c.c.p. 69-10370-9 del Tribunale d’appello -introiti AGITI- un deposito di fr. 240.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;
considerato come il versamento sia stato effettuato solo il 25 novembre 1999 e come, ritenuta la perentorietà del termine stesso, debba ritenersi tardivo,
decreta 1. L'appello 2 novembre 1999 __________ , avverso la decisione 22 ottobre 1999 della Pretore del Distretto di Lugano, è stralciato dai ruoli per versamento tardivo dell'anticipo.
Le spese del presente giudizio con tassa di giustizia per complessivi fr. 50.-- sono poste a carico dell'appellante.
