The Ticino Court of Appeal, Chamber for Enforcement and Bankruptcy, dealt with an appeal against a 5 February 2004 decision of the Locarno-City Justice of the Peace. After warning the appellant to pay an advance of CHF 255 by 1 April 2004, the court found that payment was made only on 2 April 2004. Treating the deadline as peremptory, it struck the appeal from the roll and ordered the appellant to pay CHF 50 in court costs.
Art. 312 CPC; late payment of a court-ordered advance on costs after expiry of a peremptory deadline results in the appeal being struck from the roll. Where the warning expressly threatens that consequence, the appellate court need not examine the merits. The costs of the discontinued appellate proceedings are ordinarily borne by the appellant whose procedural default caused the non-admission.

richiamata la diffida 9 marzo 2004 del presidente di questa Camera mediante la quale al ricorrente veniva assegnato un termine scadente il 1° aprile 2004 per effettuare sul c.c.p. 69–10370–9 del Tribunale d’appello –introiti AGITI– un deposito di fr. 255.– a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;
considerato come il versamento sia stato effettuato solo il 2 aprile 2004 e come, ritenuta la perentorietà del termine stesso, debba ritenersi tardivo,
decreta 1. L'appello 3 marzo 2004 di __________, avverso la decisione 5 febbraio 2004 del Segretario assessore della Pretura della giurisdizione di Locarno–Città, è stralciato dai ruoli per versamento tardivo dell'anticipo.
Le spese del presente giudizio con tassa di giustizia per complessivi fr. 50.– sono poste a carico dell'appellante.

No. Because the advance was paid after the peremptory deadline, the appeal had to be struck from the roll as discontinued.
The court treated the deadline set in the warning order as peremptory; payment on 2 April 2004 was therefore late and triggered the threatened procedural consequence.
