The complainant filed a supervisory complaint against the Lugano enforcement office in two enforcement proceedings. After the court had granted suspensive effect by presidential decree, the complainant withdrew the complaint in writing on 14 June 1996. The Camera di esecuzione e fallimenti of the Ticino Court of Appeal held that the matter had become moot and ordered the complaint struck from the docket. It also decided that no costs would be charged and no compensation would be granted.
Art. 67 cpv. 2 and Art. 68 cpv. 2 OTLEF; withdrawal of a supervisory complaint in debt enforcement proceedings renders the matter devoid of object and leads to striking it from the docket. In such a case, the court may order no costs and no indemnities, depending on the circumstances and the procedural posture, when the appeal is no longer adjudicated on the merits (consid. implicit).
