The supervisory complaint against a Lugano debt enforcement office was rendered moot because the office, after the creditor withdrew the enforcement, annulled both the enforcement and the seizure notice. Since that later decision was not challenged, the camera struck the complaint from the docket. It ordered no costs and no indemnities.
Art. 67 cpv. 2 and 68 cpv. 2 OTLEF; a supervisory complaint becomes moot when the challenged enforcement measure is annulled by the enforcement office and that subsequent decision is not itself appealed. In such a case, the reviewing authority strikes the complaint from the docket. Where the matter is moot, it may dispense with court costs and indemnities.

preso atto che con decisione 4 dicembre 1996 l’UE di Lugano ha
annullato sia l’esecuzione n. __________ che l’avviso di pignoramento 23 ottobre 1996, avendo il creditore ritirato l'esecuzione;
ritenuto che la pregressa decisione, munita dell’indicazione dei mezzi di ricorso, non è stata impugnata;
considerato come il reclamo sia così divenuto privo d’oggetto;
richiamati gli art. 67 cpv.2 e 68 cpv. 2 OTLEF
pronuncia
Il reclamo 2 dicembre 1996 di __________ è stralciato dai ruoli nel senso dei considerandi.
Non si prelevano spese e non si assegnano indennità.
