The bankruptcy supervision chamber of the Ticino Court of Appeal dealt with two supervisory appeals filed in January 1997 against the conduct of a special bankruptcy administrator. The appellant’s counsel withdrew both appeals by letter of 29 May 1998. The court held that the appeals had become moot and ordered them struck from the docket. It further ruled that no court costs would be charged and no compensation would be granted.
Art. 61 cpv. 2 lett. a and 62 cpv. 2 OTLEF; withdrawal of a supervisory complaint before the supervisory authority renders the proceedings devoid of object and leads to striking the matter from the roll. In such a case, absent a contrary basis, no costs are levied and no indemnity is awarded. The withdrawal need not be accompanied by a substantive determination on the merits; the court confines itself to noting mootness and ordering the procedural discontinuance (consid. implicit).
