The complainant challenged an attachment notice issued by the Lugano enforcement office. The supervisory court had previously granted suspensive effect. Before judgment on the merits, the complainant withdrew the complaint by declaration of 16 February 2000. The court held that the appeal had therefore become moot and ordered it struck from the docket. It also decided that no costs would be charged and no indemnity awarded.
Art. 61 cpv. 2 lett. a and Art. 62 cpv. 2 OTLEF; withdrawal of the complaint before the supervisory authority renders the proceeding moot and justifies striking it from the roll. In such a case, the court may terminate the matter without entering into the merits and may order that no costs or indemnities be levied, where the procedural posture so warrants (consid. implicit).
