In a supervisory debt-enforcement complaint, the court noted that the creditor had withdrawn the complaint on 20 January 2000. It therefore found the case moot and struck it from the roll. The court also ordered that no court costs be collected and that no indemnity be awarded. A further appeal to the Federal Debt Enforcement and Bankruptcy Chamber was indicated within ten days under Art. 19 LEF.
Art. 20a cpv. 1 LEF; Art. 61 cpv. 2 lett. a and 62 cpv. 2 OTLEF: when a supervisory complaint is withdrawn, the proceedings become devoid of object and must be removed from the docket. In such a situation the authority may simply strike the matter from the roll; no costs or indemnities are to be awarded absent a basis to the contrary (consid. implicit).
