Sintesi Omnilex

The civil cassation chamber of the Ticino Court of Appeal held that it was not competent to hear a cassation complaint against a repatriation order requiring the appellant to leave Ticino by 13 November 1998. Since the impugned decision expressly indicated that the competent authority was the Consiglio di Stato, the court applied Art. 126 CPC and transmitted the filing ex officio to that authority, notifying the complainant and forwarding the appeal with its annexes.

Massima Omnilex

Art. 126 CPC; filing before an incompetent judicial authority in a matter falling within administrative competence: the seized court must, ex officio and without examining the merits, transmit the submission immediately to the competent authority and notify the party. The transmission duty applies even where the impugned decision itself indicates the proper authority. The court does not decide the merits or regularity of the underlying measure; it confines itself to the competence question (consid. 1).
