The Pretura penale of Bellinzona dealt with an execution proceeding for conversion of an unpaid fine. The defendant, a Serbian national whose whereabouts were unknown, had been fined CHF 100 by a prior decree and had not paid despite failed collection attempts. Applying the statutory conversion rate, the court allowed the request and ordered that the fine be commuted into 3 days of arrest. Intimation was ordered through edictal channels.
Art. 49 cifra 3 CP; Art. 347 CPP; commutation of an unpaid fine into arrest. Where a fine remains unpaid and enforcement attempts fail, the competent authority may convert it into custodial arrest at the statutory rate of one day per CHF 30, subject to the maximum term provided by law. The conversion presupposes enforceability of the fine and unsuccessful collection efforts; the court then determines the corresponding number of days of arrest by simple arithmetic calculation, without discretion as to the tariff rule (consid. 1).
