The President of the Pretura penale ruled on an appeal against a decision of the Sezione della circolazione. After the authority itself asked, by letter of 11 April 2003, that the disputed decision be annulled, the court annulled the decision of 21 March 2003 and struck the appeal from the docket. No court fees or expenses were imposed.
Appeal proceedings may be struck out where the challenged administrative decision is annulled at the request of the issuing authority; in such a case the appeal loses its object. Where the court orders the appeal removed from the rolls, it may further decide that no fees or costs are to be charged.
