The president of the Pretura penale dealt with an appeal filed on 22 February 2003 against a decision of the Sezione della circolazione dated 7 February 2003. After the traffic authority itself requested, by letter of 28 February 2003, that its decision be annulled, the court annulled the contested decision and struck the appeal from the docket. No fees or costs were imposed.
Where the authority whose decision is challenged requests annulment of its own decision, the appeal proceedings may be struck from the docket once the contested decision is annulled; in such circumstances, no fees or costs need be levied (consid. 1-2).
