The appellants filed an appeal against decisions of 14 December 1999 concerning complementary benefits. After the court had set a deadline for the respondent to file a response, the appellants informed the court by letter of 26 January 2000 that they were withdrawing the appeal. The president of the Ticino Cantonal Insurance Court held that the case had become moot and ordered it struck from the docket, with no fees or costs charged.
Withdrawal of appeal; mootness; costs. Where the appellant withdraws the appeal before judgment, the proceedings become devoid of object and are struck from the docket. In such circumstances, and absent contrary grounds under the applicable procedural law, no court fees or costs are charged (consid. 1-2).
