The insured person appealed a 27 July 2001 decision of the Cantonal Compensation Fund concerning complementary benefits. After the court had set a deadline for the respondent’s answer, the appellant’s lawyer informed the court on 11 April 2002 that the appeal was withdrawn because the parties had reached an agreement on the amount to be repaid. The Tribunal Cantonale delle Assicurazioni held that the case had become moot, struck it from the docket, and ordered that no fees or expenses be collected.
Legge di procedura 6.4.61; withdrawal of the appeal and mootness of the proceedings: where the appellant withdraws the remedy after the parties have reached an agreement, the court strikes the case from the docket. In such circumstances, and absent a further contentious issue, no court fees or expenses are levied (consid. implicit).

vista la lettera 11.4.02 del rappresentante della ricorrente che comunica il ritiro del ricorso avendo raggiunto, nel frattempo, un accordo con la Cassa a proposito dell'importo da restituire (VI);
rilevato che la causa è divenuta priva di oggetto;
viste le disposizioni della Legge di procedura 6.4.61;
decreta 1. la causa è stralciata dai ruoli;
non si percepiscono né tasse né spese;
intimazione alle parti a sensi ed effetti di legge.
