An insured person appealed an opposition decision in accident insurance, seeking recognition of the reported event as an accident and payment of statutory benefits. During the proceedings, counsel informed the Ticino insurance court that the appellant wished to withdraw the appeal; counsel later also withdrew the request for judicial legal aid. The court therefore struck the case from the docket, ordered no justice fee, and placed the costs on the State.
Art. 23 LPTCA; Art. 352 CPC: withdrawal of the appeal during proceedings renders the case moot and leads to striking it from the docket. If the applicant also withdraws the request for judicial aid, no separate ruling is required thereon. Upon withdrawal, the court may waive court fees and charge the costs to the State.

la decisione del 29 ottobre 1998 emanata da
in materia di assicurazione contro gli infortuni
ritenuto, - che, con ricorso 1.2.1999, __________ __________i, rappr. dall'avv. __________ __________, ha chiesto l'annullamento della decisione su opposizione emanata il 29.10.1998 __________ e la condanna dell'istituto "ad assumere il caso notificatogli del 27 maggio 1997 alla stregua di un infortunio e quindi ad erogare all'assicurato tutte le prestazioni di legge" (I);
che, con risposta 10.2.1999, __________ ha postulato la reiezione del gravame (III);
che, con atto 20 agosto 1999, il patrocinatore dell'assicurato ha comunicato quanto segue al TCA:
" Con riferimento alla pratica di cui a margine ed alla richiesta del 16 corrente le comunico che soltanto negli scorsi giorni ho saputo che la __________, a modifica della precedente decisione, ha versato indennità soltanto fino al 25 ottobre 1988, chiudendo in seguito il caso.
Il signor __________ mi ha comunque autorizzato a ritirare il ricorso, per cui la procedura nei confronti __________ può essere stralciata."

Per questi motivi
in applicazione degli art 23 LPTCA e 352 CPC
dichiara e pronuncia
1.- La causa é stralciata dai ruoli.
2.- Non si percepisce tassa di giustizia, mentre le spese sono poste a carico dello Stato.
3.- Intimazione alle parti.
