In an accident insurance appeal before the Ticino Cantonal Insurance Court, the appellant withdrew the appeal after the insurer had requested dismissal. The vice-president therefore struck the case from the docket. The court ordered no justice fee and placed the costs on the State.
Withdrawal of appeal; the proceedings are terminated by striking the case from the docket. If the appeal is withdrawn, the court no longer adjudicates the merits and may close the case without a fee, allocating the costs according to the applicable procedural rules.
