The Ticino Cantonal Insurance Court noted that the appellant had filed an appeal on 8 February 2000 seeking a recalculation of overinsurance under the health insurance law, or alternatively remission. Before the court decided the merits, the appellant informed it on 3 February 2000 that, in view of an agreement between the parties, the appeal was withdrawn. The court therefore struck the case from the docket, ordered no court fee, and put the costs on the State.
Art. 23 LPTCA; art. 352 CPC: when an appeal is expressly withdrawn by the appellant, the court strikes the case from the docket. In such a situation, the proceedings terminate without a merits determination; the court may order that no justice fee be levied and allocate the costs to the State, according to the procedural circumstances (consid. 1-2).

ritenuto che, - con ricorso 8.2.2000 __________ ha chiesto la condanna del __________ "ad effettuare il calcolo della sovrassicurazione a norma LAMal o, in via subordinata, trattandosi di una casistica ove la buona fede è provata e la situazione economica del ricorrente è precaria al signor __________ viene accordato il condono" (I);
" Essendo intervenuto un accordo tra le parti ritiro con la presente il ricorso inoltrato in data 8.2.2000." (V)
Per questi motivi
in applicazione degli art 23 LPTCA e 352 CPC
dichiara e pronuncia
1.- La causa é stralciata dai ruoli.
2.- Non si percepisce tassa di giustizia, mentre le spese sono poste a carico dello Stato.
3.- Intimazione alle parti.
