An insured person challenged an alleged denial of justice by a health insurer and asked the court to set a deadline for a formal decision. Before the court ruled on the merits, counsel withdrew the complaint because the insurer had fully accepted the client's claims. The Ticino Social Insurance Court therefore struck the case from the docket and ordered that no court fee be charged, with costs borne by the State.
Art. 23 LPTCA; art. 352 CPC: when an appeal is withdrawn after the respondent has satisfied the appellant's claims, the proceedings are to be struck off the rolls. In such a situation the court may dispense with court fees and allocate costs to the State (consid. implied by the dispositive part).
