The Ticino Administrative Court noted that the appellant withdrew the appeal against the refusal of a building permit for the enlargement of an industrial workshop. As a result, the proceedings were exhausted and the appeal was struck from the docket. The court further ordered that no court fees or expenses be charged.

preso atto che con scritto 29 ottobre 1997 il patrocinatore della ricorrente ha comunicato che:
"in nome e per conto del signor __________, proprietario dei fondi part. no. __________ e __________ di __________, con riferimento al ricorso 15 aprile 1994 contro la decisione 16/21 marzo 1994 no. 2103 del Consiglio di Stato negante il rilascio della licenza edilizia per un ampliamento del capannone sui fondi suindicati,
preso atto della sentenza 3 luglio 1997, inc. no. 52.97.126, di codesto lodevole Tribunale,

di ritirare il ricorso 15 aprile 1994."
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
