statuendo sul ricorso 7 aprile 1995 di

rappr. da: avv. __________

contro

la decisione 21 marzo 1995 (n. 1698) del Consiglio di Stato con la quale, a partire dal 1° aprile 1995, l'insorgente, nominato quale funzionario tecnico alla __________, è stato rimosso dalla carica di funzionario tecnico;

ritenuto che nelle more del procedimento, la patrocinatrice del ricorrente ha presentato copia della decisione dell'assicurazione federale per l'invalidità, con la quale l'insorgente è stato dichiarato invalido al 100% a far tempo dal 1. maggio 1995;

preso atto che il Consiglio di Stato, venuto a conoscenza di detta decisione, con scritto 6 settembre 1995 aderisce alla domanda ricorsuale del ricorrente, di cui al punto 2, e conseguentemente annulla la risoluzione 21 marzo 1995 (n. 1698);

considerato pertanto che il procedimento è così esaurito,

decreta:

  1. Il ricorso è accolto.

§. Di conseguenza è annullata la decisione 21 marzo 1995 (n. 1698) del Consiglio di Stato.

  1. Non si prelevano né tasse, né spese.

  2. Lo Stato del Cantone Ticino verserà al ricorrente fr. 500.-- a titolo di ripetibili.
