The Administrative Court of Ticino dealt with an appeal against a State Council decision that had rejected employees’ challenge to the municipality’s refusal to pay severance indemnities after suppression of their posts. At the hearing, the parties reached a settlement under which the municipality agreed to pay five indemnities corresponding to 4, 4, 2.5, 1, and 1.1 monthly salaries. The appellants withdrew the appeal and the court struck the case from the docket without costs.
Settlement and withdrawal of the appeal in administrative proceedings; where, at the hearing, the parties conclude a transaction resolving the substantive dispute and the appellants expressly withdraw the appeal, the court strikes the proceedings off the roll and, if so agreed, waives the collection of justice fees and costs. The dispositive is limited to the procedural consequence of extinction of the case; the court does not decide the merits anew.

la decisione 18 giugno 1997, no. 3022, del Consiglio di Stato che respinge l'impugnativa presentata dalle insorgenti avverso la risoluzione 27 gennaio 1997 con cui il municipio di __________ nega loro il pagamento di un'indennità di uscita per soppressione del posto;
preso atto che in occasione dell’udienza, dopo discussione, le parti sono addivenute alla seguente transazione:
"1. Il comune di __________ verserà alle ricorrenti le seguenti indennità:
__________ 4 mensilità dello stipendio precedente il licenziamento;
__________ 4 mensilità dello stipendio precedente il licenziamento;
__________ 2,5 mensilità dello stipendio precedente il licenziamento;
__________ 1 mensilità dello stipendio precedente il licenziamento;
__________ 1,1 mensilità dello stipendio precedente il licenziamento.
La tassa di giustizia applicata dal Consiglio di Stato non viene prelevata.
A queste condizioni le ricorrenti ritirano il ricorso.
Il Tribunale procederà allo stralcio senza spese."
considerato pertanto che il procedimento è così esaurito,
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
