The Ticino Administrative Court dealt with an appeal against a Council of State decision upholding a municipal permit for a perimeter wall. At the hearing of 26 May 1997, the appellants withdrew their appeal subject to the wall being built at least 2 meters from the intersection with the municipal road and agreed to pay CHF 300 in party costs. The court therefore held the proceedings exhausted, struck the appeal from the docket, charged no court fees or costs, and ordered payment of CHF 300 in party costs.
Withdrawal of an administrative appeal; strike-out of the proceedings once the appellant withdraws the remedy, the dispute is deemed exhausted and no merits judgment is required. In such a case, the court may order the appeal removed from the docket and regulate costs accordingly; where the withdrawal concludes the case, court fees may be waived while party costs can still be awarded to the opposing party (consid. 1-2).

preso atto che in occasione dell’udienza 26 maggio 1997, dopo discussione, i ricorrenti hanno dichiarato di ritirare il ricorso alla condizione che il muro venga costruito sino ad una distanza di 2 m dall'intersezione con la strada comunale. Gli stessi verseranno al resistente la somma fr. 300.-- a titolo di ripetibili;
considerato pertanto che il procedimento è così esaurito,
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
I ricorrenti verseranno a __________ l'importo di fr. 300.-- a titolo di ripetibili.
