la decisione 3 aprile 1997, no. 40, del Dipartimento delle istituzioni che accoglie parzialmente il reclamo 26 gennaio 1996 dei comproprietari della Residenza __________ avverso la decisione 10 gennaio 1996 del municipio di __________ con la quale veniva respinta la richiesta di indennizzo per la cessazione della fornitura del gas a seguito della chiusura dell'azienda;
preso atto che in occasione dell’udienza di sopralluogo 12 novembre 1997 i rappresentanti del comune hanno dichiarato di ritirare il ricorso;
considerato pertanto che il procedimento è così esaurito,
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
Il comune di __________ verserà alla resistente fr. 600.-- a titolo di ripetibili.
