The Commune of __________ appealed a Department of Institutions decision concerning compensation for the end of gas supply after the closure of an enterprise. At the hearing, the judge proposed a settlement, which the private respondents accepted immediately and the municipality accepted in writing. The tribunal therefore struck the appeal from the docket, annulled the departmental decision, and recorded the settlement amount of CHF 18,000. No court fees were charged for either instance.
Administrative appeal; settlement during appellate proceedings; striking the case from the roll and replacing the challenged decision. When the parties reach a valid settlement during the appeal, the court may discontinue the proceedings, annul the lower administrative decision, and give effect to the settlement in the dispositive section. In such a case, costs may be waived in full if the settlement so warrants or if the court so orders in view of the procedural outcome.

Comune di __________
contro
la decisione 3 aprile 1997, no. 41, del Dipartimento delle istituzioni che accoglie parzialmente il reclamo 24 gennaio 1996 di __________ interposto contro la decisione 10 gennaio 1996 del municipio di __________ con la quale veniva respinta la richiesta di indennizzo per la cessazione della fornitura del gas a seguito della chiusura dell'azienda;
preso atto che in occasione dell’udienza 18 novembre 1997, dopo ampia discussione, il Giudice Delegato ha proposto alle parti la seguente transazione:
"1. Il comune di __________ verserà ai sigg. __________ la somma di fr. 18'000.- così calcolata:
ritenuto che la proposta è stata accettata seduta stante dai resistenti e il comune di __________, con scritto 21 novembre u.s., vi ha aderito;
considerato pertanto che il procedimento è così esaurito;
decreta:
§. La decisione 3 aprile 1997, no. 41, del Dipartimento delle istituzioni è annullata e riformata di conseguenza.
Non si prelevano tasse di giustizia nè di prima, nè di seconda istanza.
