The Ticino Administrative Court dealt with an appeal against a State Council resolution concerning the two-year suspension of a building permit application for a single-family house. Before the court decided the merits, the appellant withdrew the appeal on 16 December 1999. The court therefore struck the case from the docket and ordered that no fees or costs be collected.
Withdrawal of an administrative appeal terminates the proceedings; the court shall strike the matter from the docket without ruling on the merits. Where the proceedings end in this manner, no court fees or costs are charged absent a contrary indication in the decision (consid. 1-2).
