The municipality appealed a State Council decision that had declared null a municipal order requiring the complete removal of unlawfully erected structures. Before the appellate court decided the merits, the municipality withdrew the appeal. The Administrative Court therefore struck the appeal from the roll and ordered that no court fees, expenses, or party compensation be charged.
Withdrawal of an administrative appeal; strike-out from the roll and costs. Where the appellant withdraws the appeal, the proceedings become moot and the court strikes the case from the roll. In the absence of a merits decision, no court fees or party compensation are levied if the court so orders in the dispositive part.
