The appellants appealed a State Council decision declaring inadmissible their challenge to a fee connected with an operating licence for a bar. Before the administrative court decided the merits, their lawyer informed the court that the appeal was being withdrawn. The president of the Ticino Administrative Court therefore held that the proceedings were exhausted and struck the appeal from the docket. The court also ordered that no fees or expenses be collected.
Administrative appeal withdrawn; proceedings become moot and are struck from the docket. Where the appellant withdraws the remedy before judgment, the court no longer has a live dispute to decide and must terminate the proceedings by ordering removal from the register. In such a situation, and absent special circumstances, no court fees or procedural expenses are charged (consid. 1-2).
