The appellant consortium filed an administrative appeal seeking annulment of a public procurement tender published in the official gazette. Before the court ruled, the appellants informed the Tribunal cantonale amministrativo that they were withdrawing the appeal. The president therefore held that the proceedings were exhausted, ordered the case struck from the docket, and decided that no fees or costs would be levied.
Withdrawal of an administrative appeal terminates the proceedings; the court strikes the matter from the docket. If the withdrawal is notified before judgment, the case becomes moot and no court fees or expenses need be charged, absent a contrary cost order.
