The Ticino Administrative Court dealt with an appeal against the award of painting works for a multipurpose hall. Before the respondent filed an answer, the appellant withdrew the appeal. The court therefore struck the case from the docket, held that the proceedings were exhausted, and ordered that no court fees or expenses be charged and no party compensation be awarded.
Withdrawal of an administrative appeal before the respondent files its answer; the proceedings are thereby terminated and the appeal is struck from the docket. In such a situation, absent further procedural steps by the opposing party, there is ordinarily no basis for allocating party compensation (ripetibili), and the court may order that no fees or costs be levied (consid. 2).
