RI 1 appealed against a State Council resolution ordering a disciplinary investigation and imposing suspension from duty plus a salary reduction. Before the tribunal decided the merits, the appellant's lawyer notified the court on 22 September 2005 that the appeal was withdrawn. The Administrative Court therefore struck the case from the docket and ordered that no fees or costs be levied.
Withdrawal of appeal; discontinuance of proceedings. Where the appellant withdraws the appeal, the administrative court takes note of the withdrawal and removes the case from the docket; the proceedings are thereby terminated without a merits decision. In the absence of a merits determination, the court may order that no fees or costs be charged (consid. 1-2).

la risoluzione 24 febbraio 2004, n. 713, con la quale il Consiglio di Stato ha ordinato l'apertura di un'inchiesta disciplinare nell'ambito del decreto di accusa emesso nei confronti dell'insorgente, sospendendolo dalla funzione e parimenti privandolo della metà dello stipendio;
preso atto che con scritto 22 settembre 2005 il patrocinatore del ricorrente ha comunicato di ritirare il ricorso;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
