The taxpayer withdrew the appeal of 1 July 1995 in a tax matter concerning IC/IFD 1993. The Camera di diritto tributario held that, because of the withdrawal, the appeal had become moot and ordered it struck from the docket under Art. 181 cpv. 2 LT. The court further decided that no court fees or justice fees would be collected.
Art. 181 cpv. 2 LT; withdrawal of appeal and mootness: where the appellant withdraws the appeal, the proceeding loses its object and is struck out ex officio. In such a situation, the court may order that no court costs or justice fees be levied.
