The Tax Chamber of the Ticino Court of Appeal dealt with a tax appeal concerning IC/IFD 1995/1996. The appellants withdrew the appeal by letter of 7 March 1997. The court held that the appeal had therefore become moot and ordered it struck from the docket. It also decided that no costs or judicial fee would be levied.
Art. 207 cpv. 2 e 228 LT; art. 134 cpv. 2 e 142 cpv. 4 LIFD: a recourse withdrawn by the appellants becomes devoid of object and is struck from the roll. In the absence of a live controversy, the deciding court terminates the proceedings without examining the merits. Unless otherwise provided, no court costs or justice fee are levied where the appeal is removed from the docket following withdrawal.
