In an appeal concerning IC/IFD 1995, the appellant withdrew the appeal at the hearing of 18 August 1998. The Ticino Administrative Tax Chamber held that the withdrawal rendered the appeal moot and ordered it struck from the docket. It further decided that no court costs or judicial fees would be levied.
Art. 207 cpv. 2 LT, art. 228 LT, art. 134 cpv. 2 and art. 142 cpv. 4 LIFD; withdrawal of appeal: once the appellant withdraws the remedy, the appeal loses its object and is struck from the docket. In such a situation, the court may order that no costs or judicial fees be charged, depending on the applicable cantonal and federal tax procedural rules.
