The taxpayer lodged a tax appeal on 20 December 1999 and then withdrew it by letter of 18 February 2000. The Tax Chamber of the Cantonal Court of Appeal held that the withdrawal rendered the appeal moot and ordered it struck off the roll. It also decided that no court costs or justice fee would be charged.
Art. 207 cpv. 2 LT, 228 LT; art. 134 cpv. 2 and 142 cpv. 4 LIFD: if an appeal is withdrawn, the proceeding becomes devoid of purpose and is struck off the roll. In such a situation, the court may decide that no costs or justice fee are levied.
