In a tax appeal concerning IC/IFD 97/98, the appellant withdrew the appeal by letter of 27 January 2000. The Tax Chamber of the Court of Appeal held that the withdrawal rendered the proceedings moot and ordered the case struck from the docket. It further decided that no costs or justice fee would be charged.
Art. 207 cpv. 2 and 228 LT; Art. 134 cpv. 2 and 142 cpv. 4 LIFD; withdrawal of a tax appeal and mootness: where the appellant withdraws the appeal, the proceedings become devoid of object and the appeal is struck from the docket. In such a situation, the court may waive both costs and justice fee.
