The Ticino Court of Tax Law, acting on a tax appeal in IC/IFD 01/02, noted that the appellants' representative withdrew the appeal by letter of 5 July 2001. As the matter therefore became moot, the court struck the appeal from the docket and ordered that no court costs or justice fees be charged.
Where an appeal is withdrawn, the proceeding loses its subject matter and is struck from the roll; in such a case, and absent special circumstances, no court fees or justice fees are levied (Art. 207 cpv. 2 LT; Art. 228 LT; Art. 134 cpv. 2 LIFD; Art. 142 cpv. 4 LIFD).
