The appellants withdrew their challenge against the State Council decision approving the zoning plan. The Territorial Planning Court held that the case had become moot and struck the appeal from the docket. It further ordered that no court fees or expenses be collected. The decision was rendered by the Territorial Planning Court in Lugano on 19 June 1995.
Withdrawal of the appeal renders the proceedings moot; in such a situation the court strikes the matter from the docket and may order that no fees or costs be levied, absent a remaining live dispute.
