The appellant challenged the publication of a planning zone. Before the court ruled on the merits, the appellant’s counsel filed a withdrawal letter. The Tribunal of the Planning of the Territory held that the case had become moot and struck the appeal from the docket. It further ordered that no court fees or expenses be charged. The decision was communicated to counsel, the municipality, the Cantonal Council of State, and the urban-planning section.
Withdrawal of appeal; mootness; costs. If the appellant expressly withdraws the appeal, the planning dispute becomes moot and the court strikes the matter from the docket. In such circumstances, and absent special reasons, no court fees or expenses are levied (consid. 1-2).
