The appellant withdrew the appeal against the State Council resolution approving the municipal zoning plan. The Territorial Planning Court held that the matter had become moot and ordered the appeal struck from the docket. It also decided that no fees or expenses would be charged.
Where an appellant withdraws the planning appeal, the court strikes the proceedings from the docket once the case has become moot; absent a live dispute, the merits are not examined. In such circumstances, the court may order that no court fees or expenses be levied (consid. 1-2).
