The Territorial Planning Tribunal of Ticino dealt with an appeal against a Cantonal Council resolution approving certain AP/EP zoning proposals of a municipality. Before a decision on the merits, the appellants’ representative filed a letter withdrawing the appeal. The court held that the case had become moot and ordered the appeal struck out from the rolls. It also decided that no court fees or costs would be collected.
Withdrawal of appeal; mootness; costs. Where the appellants withdraw the administrative/planning appeal before judgment, the proceeding loses its object and is struck out from the docket; in such a situation, the court may order that no fees or costs be charged.
