Three appellants challenged a 26 February 1997 resolution of the Ticino Council of State concerning approval of amendments to a zoning plan. Before the Tribunal della pianificazione del territorio could decide the merits, the appellants filed a letter on 16 March 2000 withdrawing the appeal. The court held that the dispute had become moot, struck the case from the docket, and ordered that no court fees or costs be charged.
Withdrawal of an appeal renders the proceedings devoid of object; the appellate court will strike the matter from the docket. In such a situation, and absent any contrary indication, no court fees or expenses are levied (consid. 1-2).
