The appellant appealed against the State Council's approval of a municipal planning amendment concerning the inventory of buildings outside building zones. Before the merits were decided, the appellant informed the court by letter that the appeal was withdrawn. The Tribunal of Territorial Planning therefore struck the appeal from the rolls and ordered that no court fees or expenses be collected.
Withdrawal of an appeal; the court, upon being notified of the withdrawal, removes the case from the docket. In the absence of a substantive determination, the proceedings are terminated without adjudicating the merits; court costs may be waived when the withdrawal so justifies (consid. 1-2).
